1. Eligibility
 

Participation in 28.5 Basketball programs and services is limited to individuals who are eighteen (18) years of age or older. By registering for or participating in any Service, you represent and warrant that you are at least 18 years old and legally capable of entering into this agreement.

2. Services
 

28.5 Basketball provides basketball-related programming, which may include:

• Skills and development sessions

• Scrimmages and open runs

• Clinics and workshops

• Community events

• Volunteer initiatives

• Special events and tournaments

• Educational and networking opportunities

 

We reserve the right to modify, suspend, or discontinue any Service at any time without prior notice.
 

3. Registration and Payment
 

Registration may be required to participate in certain Services. All fees must be paid in full at the time of registration unless otherwise stated. Payments are processed through third-party providers, including Wix Payments and affiliated payment processors. 28.5 Basketball does not store complete payment card information. By providing payment information, you represent and warrant that you are authorized to use the selected payment method.

4. Refund and Cancellation Policy
 

Unless otherwise stated for a specific event or program:

• Participants may receive a full refund when cancellation is requested at least forty-eight (48) hours before the scheduled event or session.

• Participants may receive a fifty percent (50%) refund when cancellation is requested between twenty-four (24) and forty-eight (48) hours before the scheduled event or session.

• No refunds will be issued for cancellations made less than twenty-four (24) hours before the event or session.

 

Emergency situations may be considered on a case-by-case basis at the sole discretion of 28.5 Basketball. Failure to attend a registered event, session, or program without notice is considered a no-show and is not eligible for a refund.

5. Participant Responsibilities

Participants are expected to conduct themselves in a respectful, inclusive, and sportsmanlike manner.

 

Participants agree not to:

• Harass, discriminate against, or intimidate others

• Engage in violent or threatening behavior

• Damage facilities, equipment, or property

• Disrupt events, programs, or activities

• Violate applicable laws or facility policies

 

28.5 Basketball reserves the right to remove any participant from a program, event, or activity without refund for violations of these standards.

6. Assumption of Risk
 

Participation in basketball and athletic activities involves inherent risks, including physical injury, illness, disability, and other risks that cannot be completely eliminated. Participation in any 28.5 Basketball activity is voluntary and undertaken at the participant's own risk. Participants may be required to sign a separate Waiver and Release of Liability Agreement as a condition of participation.

7. Intellectual Property
 

All content available through our website and Services, including but not limited to text, graphics, logos, photographs, videos, program materials, branding, and designs, is the property of 28.5 LLC or its licensors and is protected by applicable intellectual property laws.
 

No content may be copied, reproduced, distributed, modified, or used without prior written consent.

8. Photography and Media
 

By attending a 28.5 Basketball event or program, participants acknowledge that photographs, video recordings, and other media may be captured. Subject to applicable law and any separate media release agreements, participants grant 28.5 Basketball permission to use such media for promotional, educational, marketing, and organizational purposes.
 

9. Third-Party Services
 

Our website and Services may contain links to third-party websites, platforms, or services.
 

28.5 Basketball is not responsible for the content, privacy practices, policies, or operations of third-party websites or providers. Your use of third-party services is governed by their respective terms and policies.
 

10. Disclaimer of Warranties

To the fullest extent permitted by law, 28.5 Basketball disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee uninterrupted access to our website, programs, or Services.
 

11. Limitation of Liability

To the fullest extent permitted by law, 28.5 Basketball LLC, its members, managers, employees, contractors, volunteers, partners, sponsors, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to the use of our Services.

In no event shall our total liability exceed the amount paid by the participant for the applicable Service giving rise to the claim.
 

12. Indemnification
 

You agree to defend, indemnify, and hold harmless 28.5 Basketball LLC and its affiliates, officers, members, employees, volunteers, and representatives from any claims, damages, liabilities, losses, costs, or expenses arising from:

• Your participation in our Services

• Your violation of these Terms

• Your violation of applicable law

• Your infringement of the rights of another person or entity
   

13. Governing Law and Venue
 

These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to conflict of law principles. Any dispute arising from or relating to these Terms or the Services shall be brought exclusively in the state or federal courts located within New York, and participants consent to the jurisdiction of those courts.
 

14. Changes to These Terms
 

28.5 Basketball reserves the right to update or modify these Terms at any time.Changes will become effective upon posting to our website. Continued use of the Services after changes are posted constitutes acceptance of the revised Terms.
